Compulsory purchase order legislation allows local authorities to purchase the land property needed to help deliver regeneration. The Council cannot exercise its CPO powers to compulsorily purchase your property until the appropriate Government Minister confirms the compulsory purchase order. The CPO process has to go through various stages before the powers are confirmed and can be exercised. The diagram shows those stages. Stage 8 (‘Decision’) is the Minister’s decision to confirm or reject the CPO which the Council has made (at stage 4).
Since this process can take time and be expensive, some Local Authorities offer to purchase your property by private treaty (without CPO powers) including paying your professional costs. This purchase is down to negotiation and can only be done by agreement with you.
